PRIVACY POLICY

PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING THIS SITE
Thank you for visiting our CollectionB.us website (“Site”) and reviewing our privacy policy (“Privacy Policy”). The CollectionB.us website is operated by Bernardo Fashions, LLC (“Bernardo”) and we care about your privacy. This Privacy Policy outlines the type of Personal Information that is collected by Bernardo from consumers and how we use and protect it. This Privacy Policy also tells you what to do if you do not want your Personal Information used for marketing purposes, and how you can change information you have already provided to us. This Privacy Policy applies to this Site and sweepstakes and promotions conducted through this Site. It does not apply to banners, sweepstakes or promotions sponsored by third parties in which Bernardo participates.

Your Consent to This Privacy Policy
By providing Bernardo with Personal Information, you acknowledge that you agree with the terms of our current Privacy Policy as posted here. If you do not agree with any term in this Privacy Policy, please do not provide any Personal Information through this Site.

If you choose not to provide Personal Information, you may not be able to do certain things, like access particular areas of our websites, enter sweepstakes or contests, request samples, or send us e-mail.

Collection of Personal Information
As used in this Privacy Policy, "Personal Information" means personally identifiable information such as your name, street address, telephone number, credit card information, birth date, gender, username or screen name, photograph, and email address.

When you provide us with Personal Information, you are authorizing us to use that information in accordance with the terms of this Privacy Policy, which includes your right to limit our use of your Personal Information (see Contact Information).

We may also collect Personal Information from you about a third party (e.g., a website might allow you to send an electronic "post card" to a friend, in which case we will need that person's name and e-mail address). Please note that we use such information only for the specified purpose (e.g., to mail the post card) and we will not contact the third party again unless and until the third party contacts us.

How We Use Your Information
When you supply us with your Personal Information we will use it for the express purpose for which it was collected (e.g., to enter you in a sweepstakes), and we also may make use of such Personal Information as described below. Personal Information collected as a result of your use of this Site may be used by the brand responsible for the Site or promotion, as well as by our other brands, to contact you regarding other products and services which may be of interest to you (including those we may offer jointly with other companies).

We may share your Personal Information with third-party service providers that assist us in maintaining, operating and improving this Site. For example, at times we may retain third parties to analyze data we collect, including Personal Information, to help us improve our products and our web sites. In addition, if you order a product or service from us, we may provide Personal Information to suppliers and other third parties to enable delivery of such product or service. These third parties, including suppliers, are not authorized by us to use your Personal Information in any other way.

We may supplement the information that you provide to us with other information that we receive from third parties. We do this for marketing purposes in order to provide the most appropriate products and services to meet your needs.

We may also transfer, sell or assign your Personal Information to any entity to which we divest all or a portion of our business (for example, in connection with our sale of a brand), to the extent that you provided such information to the specific portion of our business (or brand) that is being divested, or otherwise in connection with a merger, consolidation, change in control, reorganization or liquidation of all or a portion of our business.

Finally, please note that we will release your Personal Information if required to do so to protect our business interests, to comply with law enforcement, or in response to a search warrant, subpoena or court order.

Other Information We Collect Online
Even if you do nothing during your visit but browse through the Site, read pages, or download information, we will gather and store certain information about your visit automatically. This information does not identify you personally. We automatically collect and store only the following information about your visit:

• The Internet domain (for example, "xcompany.com" if you use a private Internet access account, or "yourschool.edu" if you connect from a university's domain) and IP address (an IP address is a number that is automatically assigned to your computer whenever you are surfing the Web) from which you access our Site;
• The type of browser and operating system used to access our Site;
• The date and time you access our Site; and
• The pages you visit.

Site measurement statistics may be used to personalize your Site experience, as well as to evaluate statistics about usage of the Site. This is to ensure that our Site presents the best web experience for visitors.

You may have heard of "cookies," which are files or pieces of information that are stored by your browser on your computer's hard drive. Bernardo may use cookies to collect other information during your visit to our Site, such as the particular Site areas you visit and the products or services you buy through our Site. We collect this information to better tailor our Site and our products to your interests and needs. Cookies may also be used to help speed up your future activities at our Site. For example, a cookie can help us recognize that you have provided Personal Information to us and refrain from requesting the same information a second time.

Most browsers are initially set to accept cookies. If you'd prefer, you can set yours to refuse cookies or to alert you when cookies are being sent. Refusal of cookies may result in an inability to visit certain areas of the Site or to receive personalized information when you visit the Site.

Children's Privacy Policy
The Children's Online Privacy Protection Act ("COPPA") requires that we inform parents and legal guardians about how we collect, use, and disclose personal information from children under 13 years of age; and that we obtain the consent of parents and guardians (collectively, “parents”) in order for children under 13 years of age (each a “child” and collectively “children”) to use certain features of our Web sites. We do not collect personal information from children unless they register on the Site.  The only information we collect from children during our registration process is [a child’s first name, parent's e-mail address, child’s birth date, member name, and Site password]. We collect birth dates to validate the ages of our guests, including children. We also will collect a child's e-mail address from a parent for the purpose of sending the child e-mail related to a subscription.

We may collect personal information from parents in order to allow children to participate in certain features located on our Site. In the course of a child’s participation in these features, a child may also provide us additional information about himself or herself[, such as the contents of his or her chat or message board postings]. If a parent allows us to collect personal information about their child, we may link certain information collected through technology to that personal information.

If a child registers for a sweepstakes or contest, we use the parent's e-mail address to notify the parent of the child's registration request. We may collect a child's e-mail address from the parent in order to send the child a newsletter. In addition, personal information regarding a child may be collected and used to enable a child's participation in certain interactive features such as sending e-mail, interacting with social media sites and other similar activities. These activities may involve disclosure of a child's personal information to third parties. In addition, we may share a child's personal information with third parties to the extent reasonably necessary to: protect the security of integrity of our sites; to take precautions against liability; to respond to judicial process; or to the extent permitted under provisions of law, to provide information to law enforcement agencies or for an investigation related to public safety.

We send parents an e-mail when their child registers and enters a sweepstakes or contest and we provide parents 48 hours to refuse their child's registration and entry in the sweepstakes or contest. If the parent refuses to allow the child's registration and entry, we delete the child's information from our database. If we don't hear back from the parent, we assume it is acceptable for the child to be registered and entered in the sweepstakes or contest. Once a parent permits a child to register, the child will be able to enter future registration-based sweepstakes or contests without any further notification to the parent. If a child wins a sweepstakes or contest, we notify the parent at the parent's e-mail address provided to us during the registration process and request that the parent provide their postal address for purposes of delivering the prize. We may publish a winner's first name, first initial of last name, city, and state of residence on our Site.

We collect personal information from children when they participate in activities such as sending emails through the Site or linking to third-party social media sites. Before allowing a child to use these features, we send an e-mail to the child's parent requesting the parent's affirmative consent to the child's participation. If the parent responds by e-mail and gives such consent, we then follow that communication with an e-mail confirmation to the parent.

Before allowing a child to use a feature of our Site that might result in the public disclosure of the child's information to third parties on the Internet, such as posting on open message boards, we require a high level of verification to confirm that the parent has given permission for the child's participation in such features. For example, we may require a parent to provide us credit card information, speak to a trained telephone operator or return by postal mail or fax a signed consent form.

At any time parents can refuse to permit us to collect further personal information from their child and can request that any personal information we have collected be deleted from our records. A parent can contact our customer service department to access, change, or delete the personal information that we have collected from his or her child by sending an e-mail to info@bernardofashions.com. Please include the child's user name and the parent's e-mail address in the e-mail so that we can better assist you with your inquiry or request.
